Training Software Agreement
By installing or using EKG Trainer, the user agrees that the application is licensed for educational ECG training and simulation use only. It is not a medical device, patient monitor, diagnostic system, treatment tool, or replacement for qualified clinical instruction, local protocol, medical direction, or professional judgment.
License Grant
The publisher grants the user a limited, revocable, non-exclusive, non-transferable license to install and use the application for personal, educational, classroom, or internal training purposes, subject to these terms.
Restrictions
The user may not reverse engineer, resell, sublicense, redistribute modified copies, remove notices, bypass access controls, or use the software to provide clinical diagnosis or patient care decisions. These software restrictions do not limit rights granted by separate third-party licenses for the included PTB-XL Reference ECG recordings or the unmodified CardioNetworks ECHOpedia echocardiogram clips. Recipients may exercise those files' respective Creative Commons rights independently of this software license.
Educational Boundary
Simulator cases, patient profiles, visual models, generated ECG waveforms, and feedback are learning content. The separate Reference ECG gallery and normal echocardiogram atlas display attributed recordings that are independent of the fictional cases. Users must verify clinical knowledge against approved curriculum, medical direction, and qualified instruction.
Clinical Responsibility
The user is responsible for following their own scope of practice, employer policy, local protocol, certification requirements, and applicable law. The app does not authorize any clinical skill or expand clinical scope.
Ownership
The application, visual assets, code, simulations, course materials, and training content remain the property of the publisher or applicable rights holder. The PTB-XL reference recordings retain their source attribution and Creative Commons Attribution 4.0 rights. The unmodified CardioNetworks ECHOpedia echocardiogram clips retain their source attribution and Creative Commons Attribution-ShareAlike 3.0 rights, including the right to share and adapt the clips under that license. The software is licensed, not sold.
Updates
Updates may add, change, or remove features, content, cases, layouts, and training tools. Continued use after an update means the user accepts the updated application behavior and terms included with that version.
Privacy
Local saved progress, quiz history, and preferences are addressed in the Privacy Policy. Users should not enter real patient identifiers, protected health information, or live clinical data into the simulator.
No Warranty
The software is provided as-is for training use. To the maximum extent permitted by law, the publisher disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, the publisher is not liable for indirect, incidental, consequential, special, exemplary, or clinical-care-related damages arising from use or inability to use the software.
Termination
The software license may terminate if the user violates these terms. Upon termination, the user must stop using the software and uninstall or delete application copies under their control. Termination does not remove rights granted directly by the separate licenses for included third-party recordings.
Institutional Use
Schools, agencies, departments, and training programs are responsible for validating course fit, documenting approvals, supervising learners, and determining whether the software satisfies any local education requirement.
Legal Review
This template should be reviewed and finalized by qualified legal counsel before public distribution, paid licensing, institutional sale, app-store release, or continuing-education deployment.
